THIS IS A THIS IS A LEGALLY BINDING RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT (the “Agreement”). Please read it carefully before signing/accepting/acknowledging.
If you are obtaining a quote for and/or securing or procuring travel for more than just yourself, all references below to “I” (and derivations thereof, including without limitation “my” and “me”) shall be read to mean you on behalf of yourself and each individual within your group for whom you are obtaining a quote and/or securing or procuring travel.
TERMS AND CONDITIONS
I understand that MICHAELA TRAVELS is not the source or supplier of the travel services I have requested, and acts solely as an agent for the actual suppliers of such services. I have been advised that the suppliers whose names appear in the information supplied to me are those who are actually responsible for providing the travel services I have purchased. I consent to and request the use of those suppliers and agree not to hold MICHAELA TRAVELS responsible should any of these suppliers: 1) fail to provide the travel services I have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any sort of injury, damage, delay or inconvenience.
MICHAELA TRAVELS is not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the Suppliers and no liability for recommending a trip credit in lieu of a refund.
MICHAELA TRAVLES assumes no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at travel.state.gov, click on "Find International travel Information" then click on "Country Information", and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at cdc.gov/travel, then click on "Destinations" and scroll to the name of the destination country. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.
I will review my travel documents for accuracy upon receipt and understand that I may contact MICHAELA TRAVELS if I have any questions. I understand that it is my responsibility to review the accuracy of all details in the travel quotations provided to me and to confirm the same to MICHAELA TRAVELS.
I will assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Make sure to note rules are subject to change whether your travels are foreign or domestic. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel. MICHAELA TRAVELS. I understand that if traveling internationally, I must have a valid passport and depending upon my destination and nationality, I may need to obtain one or more visas.
I understand that the Transportation Security Administration (TSA) requires me to carry a government issued identification card in order to board a flight. I have been advised that the name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on my airline ticket and in my booking records. I acknowledge that my failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing me to miss my flight.
MICHAELA TRAVELS has no special knowledge regarding the financial condition of travel service providers selected for your tour, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, MICHAELA TRAVELS recommends contacting the Travel Warnings Section of the U.S. State Department at 1-888-407-4747 or www.travel.state.gov. For medical information, contact the Centers for Disease Control at 1-800-232-4636 or www.cdc.gov/travel.
I understand that all reservation fares typically involve restrictions (including, but not limited to, restrictions related to cancellation) and that changing any aspect of my travel arrangements may result in the payment of additional money. If a Supplier drops the price of a trip after booking, we will try to assist you with rebooking if the Supplier allows it, and a fee may apply. We do not guarantee any refunds or successful rebooking
Travel arrangements involving airline and cruise components are subject to Suppliers' supplemental price increases that may be imposed by the supplier and/or government, even after completed purchase. I hereby consent to any such price increases and authorize my credit or debit card to be used for them.
I understand that Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and I may be bound by those contracts regardless of whether I receive notice of their terms
I agree not to purchase a ticket or tickets containing flight segments that I will not be using, such as a "point-beyond", "hidden-city", or "back-to-back tickets". I further agree not to purchase a round-trip ticket that I plan to use only for one-way travel. I acknowledge that the airlines generally prohibit all such tickets, and therefore MICHAELA TRAVELS does not guarantee that the airline will honor your ticket or tickets. I understand that If I do not use one of the flights in my reservation, the airline will cancel my remaining itinerary, and it may confiscate my frequent flyer points. I agree to indemnify MICHAELA TRAVELS against airline claims for the difference between the full fare of my actual itinerary and the value of the ticket or tickets that I purchased
I shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through MICHAELA TRAVELS By submitting a credit card authorization form to MICHAELA TRAVELS, I agree to allow MICHAELA TRAVELS to use my payment method to purchase travel products from their Suppliers on my behalf. EXCEPTING IN CASES OF FRAUD, I AGREE NOT TO FILE ANY DISPUTE WITH MY BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS OF MICHAELA TRAVELS OR ITS SUPPLIERS, INCLUDING CANCELLATIONS OR CHANGES OF ITINERARY OR ARRANGEMENTS FOR REASONS BEYOND THE CONTROL OF MICHAELA TRAVLES OR ITS SUPPLIERS. IF I ATTEMPT TO CHARGEBACK, REVERSE OR RECOLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT, MICHAELA TRAVELS RESERVES THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL OR RECOLLECTION, INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES.
All payments for travel are due prior to departure according to each Supplier’s terms and conditions of booking. I understand that failure to make final payment or any violation of a Supplier’s conditions of purchase may result in cancellation of my reservations, in me being denied access to any flights, tours, hotels, cruises, or other travel services, or in me forfeiting any monies paid for my reservations. In some cases, there is NO REFUND once a booking is made and under deposit. I may not be entitled to a refund if I change or cancel my travel plans after confirmation of a booking. All cancellation requests must be sent to MICHAEL TRAVELS in writing. As a result of cancellation or changes to confirmed bookings, third-party Supplier’s cancellation penalties will apply. Cancellation fees will be charged to the credit card or other payment method I authorized to pay for travel services or deducted from the Supplier’s refund. If I decide to change any portion of my confirmed arrangements prior to departure or during my trip, MICHAELA TRAVELS will attempt to assist me. Certain bookings may not be able to be changed, and I will be responsible for any increases in cost imposed by the Supplier, as well as any MICHAELA TRAVELS or Supplier change fees. All requests for changes to a booking must be made in writing to MICHAELA TRAVELS. When tour, cruise or package prices are based on Suppliers’ contract rates, I will not be entitled to any refund for any unused portion of travel. If I have authorized MICHAELA TRAVELS to make travel arrangements using my frequent flyer miles or loyalty points, I may be required to provide MICHAELA TRAVELS with passwords or log-in information for my accounts. Any reservations made using miles or points are subject to the terms of the applicable loyalty program.
MICHAELA TRAVELS reserve the right to correct errors. In the event of any pricing error or omission, MICHAELA TRAVELS reserves the right to adjust such pricing or make any other corrections. All offers, incentives and Supplier promotions are subject to availability and may change without notice. I am advised to confirm reservations well in advance of my anticipated dates of travel to avoid disappointment, increases in fares and additional late booking fees.
For my protection, MICHAELA TRAVELS strongly recommends that I purchase trip cancellation and travel accident insurance. Please note that most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by MICHAELA TRAVELS constitutes a binding assurance or promise about the insurance.
I agree to hold MICHAELA TRAVELS harmless for my election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy
Cancellation Fees and Non Refundable Payments
All cancellation fees/penalties are from the supplier/vendor/hotel. It is MINE, the traveler’s responsibility to review the terms and conditions on my invoices.
I, the traveler agree that the term “non-refundable” in any quotes, bookings, or invoices means that the booking cannot be refunded under any circumstance, including for reasons of pandemic, war, force majeure, or other unforeseeable events.
I, the traveler waive my right to sue or institute a credit card dispute or “charge back” to MICHAELA TRAVELS or its partners and suppliers for said penalties, fees, or real or alleged damage related to non-refundable deposits/payments or any other transaction. The travel agent must be reimbursed by the client for any financial penalties incurred due to credit card “chargebacks”.
The laws of the State of Florida govern the rights and obligations of the parties to this Agreement and the interpretation, construction and enforceability thereof. I agree that any action or proceeding brought by me against MICHAELA TRAVELS shall be brought solely in the courts of Florida located in Osceola County
